Boost Your Game Competition Rules
ARTICLE 1 - Organiser
The competition AA Drink Spartacus Series and Rotterdam Harbour Run (hereinafter: the Competition) is organised by UNITED SOFT DRINKS B.V., with its registered office at Reactorweg 69, 3504 AA Utrecht, The Netherlands (hereinafter: the Organiser). These regulations set out the rules and conditions that apply to the Competition. No correspondence will be held regarding the rules, questions, the mechanism of the competition or the methods of selection, either by telephone or in writing.
ARTICLE 2 — Participation
Each participant in the promotion must be resident at a Belgian, German or Dutch (postal) address. Only natural persons with a minimum age of 15 years may enter the Competition. Minors may only enter the Competition with the express consent of their parents or guardian. In the event of a minor entering the Competition, the Organiser shall assume that they have the consent of their parents/guardian. Participants must be able to prove their identity and age at all times. If the minor is unable to provide this consent, he/she may be denied further participation in the Competition or have his/her right to a prize withdrawn at any time.
The following persons are excluded from entry:
• Employees of the Organiser and affiliated organisations and partners
• Their first-degree relatives or persons who live at the same address.
The entrant does not have to make any payment or contribution to the Organiser for taking part in the Competition. An entrant who wins a prize without fully complying with the entry conditions automatically loses his/her right to that prize, without any compensation or recourse. The Organiser reserves the right to exclude participants who do not comply with the conditions of these regulations, who abuse or manipulate the system, or who commit fraud or deception. The Organiser cannot be held liable for technical problems with the website and/or email system. Nor can the Organiser be held liable for any incompatibility between the technology used for the Competition and the hardware and/or software configuration used by the participant.
ARTICLE 3 - Method of participation
Anyone with a registered AA Drink account linked to the participant's personal Fitbit account and/or the participant's personal Strava account can participate in this contest. To participate in this competition, entrants must perform sport for a minimum of 30 minutes during the period 01/01/2022 to 31/01/2022. By linking the account to the personal Fitbit account/Strava account, this sports session is registered on the AA Drink platform. Every 100th registered sports session is eligible for a prize. Those who don't have a Fitbit or Strava account can also submit a photo via the website's promotion page for a chance to be the 100th participant. The Strava and Fitbit sports sessions as well as a photo upload are automatically included in the count to determine the 100th participant (and thus winner of a prize).
ARTICLE 4 - Prize
The following prizes can be won:
1/1/2022 — 09/1/2022 - Massage ball
10/1/2022 — 16/01/2022 - AA Drink bottle and Iso-Lemon pack
17/01/2022 – 23/01/2022- AA Drink Recovery socks
24/01/2022 — 31/01/2022 - AA Drink High Vis jacket
The organisation will make every effort to send the prize as stated above to the winner. If the prize won is no longer in stock, the organiser reserves the right to award and send a different prize.
ARTICLE 5 - Promotional Period
The promotion will run from 01.01.2022 at 08:00 hrs to 31.01.2022 at 23:59 hrs.
ARTICLE 6 - Winners
The winners will be informed by email of their prize via the email address provided on the entry form for the Contest. Amongst other things, the Organiser's email will also specify the further steps. The Organiser's decision regarding the determination of the winner is irrevocable and final.
ARTICLE 7 — Liability
Subject to gross or deliberate error, neither the Organiser nor its staff members nor any third party invoked in the context of the Contest may be held responsible for any damage of any kind that may arise from the organisation of the Contest, including participation in the Contest, designation of winners and acceptance of the prize. The Organiser cannot be held responsible or liable for any defect in the prize, or if the prize fails to satisfy the expectations created. Printing, spelling, or other errors, in addition to technical problems, cannot be invoked as grounds for any obligation whatsoever on the part of the Organiser. Subject to the same reservation, neither the Organiser nor the aforementioned persons can be held responsible for any delays or errors in postal and shipping services.
ARTICLE 8 — Personal Data
By entering the Contest, the participant agrees that their personal data (name, first name, email address, date of birth, telephone number, address) will be processed by the Organiser, the controller responsible for processing, in accordance with EU Regulation 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data. The data communicated by the participant will only be processed for the management of action and the award of the prizes to the winners. Each participant has the right to view their personal data at any time and/or to have it corrected upon a simple written request to the Organiser at the following address: info@usd.nl. The data will not be passed on to third parties and will be kept for as long as necessary for the purpose of organising the competition. ARTICLE 9 — Supervision
The Organiser will supervise the correct operation of the promotion. The Organiser reserves the right to exclude the entrant from the Competition in the event of non-compliance, or in the event of abuse, deception, fraud or bad faith. In such cases, the Organiser also reserves the right to require the participant to return the prize, as well as compensation for any loss or damage suffered. By entering the competition, the participant agrees to the competition rules. The organiser reserves the right at any time to make changes to the competition rules regarding the prizes and to change, extend or cancel the competition in the event of force majeure, programmatic, technical or organisational reasons. The Organiser cannot be held liable for any changes, suspension or cancellation. Participants are not entitled to any compensation. The Competition results are binding and irrevocable and cannot be contested.
ARTICLE 10 - Complaints
In the event of complaints regarding this Competition, please contact the Organiser by post or by e-mail at: UNITED SOFT DRINKS B.V. Attn. Any complaint submitted after this period will not be taken into consideration.
Article 11 - Applicable law and jurisdiction
These regulations are governed by Dutch legislation and are interpreted or implemented in accordance with Dutch law. The courts under the jurisdiction of the Organiser’s registered office have sole authorisation for settling any disputes that may arise from this Competition or from the interpretation or application of these rules.
